These Terms of Use govern your access to and use of tylermarcusbooks.com (the “Site”), operated by Tyler Marcus Books LLC under the name Tyler Marcus Books (“Tyler Marcus Books,” “we,” “us,” or “our”). By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

1. Purpose of the Site

The Site provides information about Tyler Marcus, the Of Ash and Echoes series, related books and media, free previews, author updates, and products available for purchase. The Site is intended for personal, lawful use.

2. Eligibility

You must be legally able to enter into an agreement in your jurisdiction to make a purchase. If you are under the age of majority where you live, you may use the Site only with the involvement and permission of a parent or legal guardian.

3. Intellectual Property and Preview Content

Unless otherwise stated, the Site’s text, book excerpts, audio, graphics, branding, page design, and other creative materials are owned by or licensed to Tyler Marcus Books and are protected by applicable intellectual-property laws. Names and marks belonging to third parties remain the property of their respective owners.

Book and audio previews are provided for your personal, noncommercial evaluation. You may not copy, reproduce, record, distribute, publish, sell, adapt, scrape, train an artificial-intelligence system on, or otherwise exploit Site content except as permitted by law or with prior written permission.

Purchasing an ebook or audiobook grants you a limited, personal, nonexclusive, nontransferable license to access that digital edition for your own use. A purchase does not transfer ownership of the underlying copyright or permit redistribution.

4. Acceptable Use

You agree not to misuse the Site. Prohibited conduct includes attempting to bypass security or access controls; interfering with Site operation; introducing malicious code; impersonating another person; using automated systems in a way that unreasonably burdens the Site; collecting information about other visitors; or using the Site or its content for unlawful, fraudulent, infringing, or abusive purposes.

5. Orders, Payment, and Fulfillment

Prices, availability, format details, delivery estimates, and promotions may change before an order is completed. You are responsible for reviewing your order and providing accurate billing, delivery, and contact information. We may decline or cancel an order where reasonably necessary because of suspected fraud, pricing or inventory errors, technical problems, or legal requirements. If payment has already been collected for a canceled order, the applicable amount will be refunded.

Checkout and payment processing are provided through Shopify. Print editions are fulfilled by Lulu, and digital editions are delivered through BookFunnel. Those services may apply their own terms and privacy practices to the portions of your transaction they handle. Delivery timing can be affected by third-party services, carriers, internet access, and information supplied by the customer.

Any product-specific terms, checkout disclosures, and policies displayed at the time of purchase form part of these Terms. Nothing in these Terms limits consumer rights that cannot lawfully be waived.

See our Refund Policy, Shipping Policy, and Contact Information. The voluntary 24-hour digital refund window does not limit statutory withdrawal rights or remedies. We remain responsible for our obligations as the seller when a fulfillment provider is involved.

Shopify hosts this store and processes information about your visits and purchases, including through enhanced services using interactions with other merchants and Shopify. Information may be shared with Shopify and service providers in other countries. See our Privacy Policy and Your Privacy Choices for details and available controls.

6. Reader Preferences and Resume Feature

The Site may save limited preferences in your browser, including reader text size and the last chapter or page viewed, so you can resume a preview. This information is stored for convenience on that browser and device. It is not an account, is not guaranteed to sync or remain available, and may be lost if browser data is cleared or storage is unavailable.

7. Newsletter and Communications

If you join the newsletter, you consent to receive the updates described at signup. You may unsubscribe using the link in any marketing email. Transactional messages related to an order may still be sent when necessary. Information about how personal information is handled is available in our Privacy Policy.

8. Third-Party Links and Services

The Site may link to or rely on services operated by third parties, including Shopify, Lulu, BookFunnel, newsletter providers, social networks, and media platforms. We do not control third-party sites or services and are not responsible for their content, availability, security, or practices. A link does not necessarily mean that we endorse everything on the linked service.

9. Accuracy, Availability, and Changes

We try to keep Site information accurate and the Site available, but errors, interruptions, or outdated information may occur. We may correct errors and change, suspend, or discontinue Site content or features at any time. We do not guarantee that every format, preview, product, or feature will always remain available.

10. Disclaimers

To the fullest extent permitted by law, the Site and its content are provided “as is” and “as available,” without warranties of uninterrupted operation, error-free content, fitness for a particular purpose, or non-infringement. This disclaimer does not exclude warranties or protections that cannot lawfully be excluded.

11. Limitation of Liability

To the fullest extent permitted by law, Tyler Marcus Books and its owners, contributors, and service providers will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of or inability to use the Site, previews, links, or digital features. These limitations do not apply to liability that cannot legally be limited, including liability arising from fraud, willful misconduct, or other non-waivable obligations.

12. Governing Law

These Terms are governed by the laws of the State of Colorado and applicable United States federal law, without regard to conflict-of-law principles, except where the mandatory law of your place of residence provides otherwise. Any dispute that may lawfully be restricted to a forum will be brought in a court with jurisdiction in Colorado.

13. Severability and Entire Agreement

If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect. These Terms, together with the Privacy Policy and any applicable checkout or product-specific terms, constitute the agreement governing your use of the Site.

14. Changes to These Terms

We may update these Terms to reflect changes to the Site, our services, or legal requirements. The revised version becomes effective when posted with a new effective date. Your continued use of the Site after an update means you accept the revised Terms.
